By purchasing products from Mabel Main, you agree to be bound by these Terms of Sale. These terms comply with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 in New Zealand. Mabel Main reserves the right to amend these Terms of Sale at any time, so we advise you to periodically review them.
2. Ownership and Use of Website
Mabel Main owns and operates this website. Use of this website is subject to these Terms of Sale, which apply to online transactions made on the Mabel Main website. Mabel Main reserves the right to suspend or terminate your account if the details you provide about yourself are incorrect in any way.
3. Pricing
All prices are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST), where applicable. We reserve the right to change our pricing at any time without prior notice. The price payable for your order will be confirmed at checkout. The full retail price represented on products displayed on this website has either been formulated by Mabel Main in accordance with standard industry practice, considering factors such as exchange rate, shipping costs, duty, etc. If an item has been accidentally priced incorrectly, we will contact you before shipping via phone or email.
4. Payment
We accept major credit cards and other secure payment methods as displayed on our website. Payment must be made in full before we dispatch your order. Payment can be made by Visa, MasterCard, and other methods clearly advertised on our website. Payment will be debited and cleared from your account upon submission of your order. You confirm that the credit/debit card being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Mabel Main, we will not be liable for any delay or non-delivery.
5. Orders and Availability
All orders are subject to product availability. If an item is unavailable, we will contact you to discuss options, including substituting with a similar item, backordering, or cancelling the order. Please note that our market store may also be busy, meaning there is potential for an item to be purchased in-store at the same time it is being purchased online. In the unlikely event of this happening, we will give preference to the in-store sale and contact you to organise a refund or exchange.
6. Shipping and Delivery
We aim to dispatch orders within 24-48 hours from Monday to Friday. If an order is made on Saturday, Sunday, or public holidays, dispatch will be within 24-48 hours from the next business working day. Delivery times may vary depending on your location and courier services. Mabel Main is not liable for delays beyond our control, such as courier delays or unforeseen circumstances.

7. Returns and Refunds
We accept returns for items in their original condition (unworn, unwashed, and with tags attached) within 7 days of receipt. Please read our refund policy should you encounter a issue with the product, this policy does not effect your Consumer Guarantees Act 1993 rights. We do not accept returns for items based on "change of mind" or personal preferences.
8. Faulty Items
If your item is faulty, please contact us immediately following the guides set out in our refund policy. Under the Consumer Guarantees Act 1993, you may be entitled to a repair, replacement, or refund, depending on the nature of the fault.
9. Limitation of Liability
Mabel Main will not be liable for any indirect, incidental, or consequential damages arising out of the purchase or use of our products. Our liability is limited to the value of the items purchased. Mabel Main is also not liable for any loss in connection with the use of this website or a linked website.
10. Consumer Rights
Nothing in these Terms of Sale is intended to limit your rights under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
11. Security
We take reasonable care to make our site secure. All credit/debit card transactions on this site are processed using Shopify's secure payment gateway that encrypts your card details in a secure host environment. Mabel Main does not store your credit/debit card details on our systems. Shopify handles all payment processing, ensuring your data is encrypted and secure. Furthermore, we take reasonable care, insofar as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the site.

Mabel Main is a trademarked company. Other product and company names mentioned on this website may be the trademarks of other people or entities. Nothing contained on the website should be construed as granting any license or right of use of any trademark or part of any trademark displayed on the website without the express written permission of Mabel Main or the third-party owner.
